Requesting Montgomery County Booking Records
Arkansas FOIA gives every state citizen the right to ask for booking records. The law is in Ark. Code Ann. § 25-19-101 and the sections that follow. The Arkansas FOIA Handbook puts it plainly: a citizen can make a verbal or written request for a public record. No reason is needed.
The three business day response rule is in Ark. Code Ann. § 25-19-105. The same rule caps copy fees at 25 cents per page. Agencies cannot charge for staff time. The sheriff may ask for payment up front if the total cost will run more than $25.
Your request should list the full name of the person, the date of birth, and the booking date. A booking number is helpful when you have it. State the records you want: booking sheet, mugshot, charges, bond info. Keep the request short. Email, fax, and mail are all fine. A verbal request in person works too.
The Attorney General FOIA page has sample letters and a FOIA hotline at (501) 682-2007. If the sheriff denies a request or does not respond in three business days, you can file in circuit court under Ark. Code Ann. § 25-19-107. The judge can rule in a few days. If you win, the court can make the agency pay your fees.
Note: Juvenile records are closed under Ark. Code Ann. § 9-27-309. A juvenile booking will not show on the public roster.
Montgomery County Booking Sheet Contents
A Montgomery County 24 hour booking sheet holds the same core data as any Arkansas jail. The sheet lists full name, date of birth, sex, race, height, weight, and address of the person booked. The booking number and booking date go on the sheet. The arresting agency is named. Charges are listed with the Arkansas Code cite. Bond type and amount are set. A mugshot is taken and added to the file.
Arkansas bond types include cash, surety, property, and own recognizance. The first appearance judge sets the amount, or a local bond schedule is used. Most folks post bond and go home within a day or two of the booking. Those who cannot stay in the jail until the case resolves or the bond is reduced.
Some holds can delay release. A federal hold, a state parole hold, or a warrant from another county or state mean the person will not be released until the hold is cleared. The booking sheet notes any holds.
The basic booking data stays public even when the case is live. The FOIA Handbook is clear on this point: once a booking is done, the basic facts are open, even if the larger investigation is still going. Some items are closed. Medical screens, mental health notes, and social security numbers get redacted.
